Wills / Powers of Attorney

North Carolina Living Wills

Comprehensive, Compassionate legal services since 1982: Free consultation 866-739-9799

The best gift you can leave your loved ones in the sad event of your death is a comprehensive, legally sound will and other instructions that avoid confusion between family members and ensure that your assets and property are distributed according to your wishes and not by the state or I.R.S. At the Lillington law offices of Kelly & West, a North Carolina living wills attorney  can provide personal service and a clear explanation of the benefits and consequences of the many types of vehicles available for asset protection and distribution after death. We also offer guidance in establishing living wills, healthcare directives and powers of attorney to express clearly your wishes should you be unable to speak for yourself and the designation of a trusted individual who will implement those instructions:

  • Wills: A North Carolina will is a legally binding document that determines the distribution of assets and property after death as well as the care of minor children. Legal guidance during the preparation and execution of a will can be invaluable to ensure that the will itself and the distribution are legally sound and that you avoid excessive taxation for your beneficiaries.
  • Living Will: A Living Will allows you to control the extent of medical treatment you receive should you become incapacitated and unable to speak for yourself. A living will that clearly spells out your wishes for medical treatment will spare your family both from disputes and from the agony of implementing a possibly fatal treatment without a clear understanding of your wishes.
  • Powers of Attorney: A power of attorney gives an individual the right to manage your affairs on your behalf. There are multiple types of P.O.A. but the most common are Financial and Healthcare Powers of Attorney (see below). Powers of attorney are complex and require the guidance of an experienced attorney to ensure that checks and balances are in place to protect your assets, your family and ensure that your wishes are observed.
  • Healthcare Powers of Attorney: A Healthcare Power of Attorney is different from a Living Will in that it allows you to designate an individual who will make healthcare decisions in your stead.  This document can contain the same language as a Living Will and serve both purposes.
